Special Order Terms

These Special Order Terms ("Terms") apply to any product on ElkhartRVParts.com that is designated as a Special Order Item, Made-to-Order, Made Fresh to Order, Custom, Built-to-Order, or is fulfilled directly by one of our suppliers, vendors, or drop-ship partners (collectively, "Special Order Items"). By checking the acknowledgment box on the product page and completing your purchase, you affirmatively agree to every term below. These Terms are a binding contract between you ("you," "Buyer," "Customer") and Elkhart RV Parts, operated by its ownership in Goshen, Indiana ("we," "us," "Elkhart RV Parts," or "Seller").
1. What a Special Order Item Is
Special Order Items are not stocked for immediate shipment from our own warehouse. They are ordered, built, assembled, manufactured, packaged, scheduled, reserved, or dispatched specifically in response to your purchase. This may include, without limitation:
- Items that our suppliers or partners begin producing, cutting, welding, machining, stitching, laminating, pouring, or finishing only after your order is received;
- Items reserved from a vendor's production run or allocated from limited inventory on your behalf;
- Items shipped directly from a manufacturer, brand, or distribution partner rather than from our own facility;
- Items configured, sized, specified, or color-matched to your selection;
- Items subject to freight scheduling, LTL/common-carrier booking, liftgate requests, residential delivery arrangements, or appointment delivery.
The product detail page for each item identifies when these terms apply. The acknowledgment checkbox you clicked is your confirmation that you understood this before buying.
2. Your Acknowledgment and Consent
The product page for every Special Order Item displays a clearly visible checkbox, adjacent to the "Add to Cart" button, containing the following language (or language substantially similar):
"This is a special-order item, all sales are final and no returns or exchanges will be accepted. Why? Because materials, vendor requests, and production scheduling may begin coordination once you submit your order. With many items either 'Made Fresh to Order' or fulfilled by our partners directly, please accept these terms by clicking the checkbox to the left only when you are confident this product is what you need."
The "Add to Cart" button is disabled until this box is checked. By checking the box and proceeding to checkout, you make the following affirmative representations:
- You have read and understood these Terms in full;
- You are the authorized cardholder or payment-method holder for the transaction;
- You have independently verified that the item is correct for your vehicle, equipment, or intended use;
- You understand and accept that the item is non-returnable, non-refundable, non-exchangeable, and non-cancellable once your order is submitted;
- You understand and accept that any chargeback, payment dispute, or reversal attempt initiated after this acknowledgment will be contested by Elkhart RV Parts using your recorded consent as evidence of a valid, authorized, and disclosed transaction.
Your checkbox acceptance is timestamped and recorded as a line-item property on your order (`Special Order Item: Yes`) and is retained in our order records as evidence of this agreement.
3. All Sales Final — No Cancellations, Returns, Exchanges, or Refunds
ALL SALES OF SPECIAL ORDER ITEMS ARE FINAL. Once your order is submitted and payment is captured, the order is locked and cannot be cancelled, returned, exchanged, or refunded, in whole or in part, for any reason other than those narrowly described in Section 6 (Damaged or Defective Items) below. This includes, without limitation:
- Change of mind, buyer's remorse, or finding the item elsewhere for less;
- Delays in production, manufacturing, or shipping, regardless of duration;
- Incorrect fit, size, or compatibility selected by you;
- Vehicle sale, trade-in, repair cancellation, or change in project scope;
- Refusal of delivery, failure to accept a scheduled freight appointment, or failure to be present for delivery;
- Dissatisfaction with the vendor's production timeline or communication;
- Cancellation of a related project, service appointment, or RV trip;
- Financial hardship, dispute with a third party, or changes in personal circumstances occurring after the order is placed.
This "all sales final" policy is not a default that can be waived by phone, email, or chat. It is a material condition of the sale and is priced into the product. Any verbal statement, email, text, or chat message suggesting otherwise is superseded by these Terms unless issued in writing by an officer of Elkhart RV Parts and specifically referencing your order number.
4. Production and Shipping Lead Times
Lead times shown on the product page or in checkout are estimates provided by our vendors and manufacturers. They are not guaranteed delivery dates and do not form part of the contract. Delays caused by vendors, freight carriers, weather, supply-chain disruptions, customs, manufacturing backlogs, or force majeure events are not grounds for cancellation, refund, chargeback, or compensation. You accept delivery timing risk as part of purchasing a Special Order Item.
5. Shipping, Freight, and Delivery
- Large items (fifth-wheel hitches, awnings, slide toppers, cargo trays, and similar goods) ship by LTL freight or common carrier. You are responsible for being available to receive the shipment, providing accurate delivery address information, and notifying us of any access limitations (narrow streets, no loading dock, gated communities, residential liftgate needs).
- If you refuse delivery, fail to be present for a scheduled delivery, or cause the shipment to be returned to the shipper for reasons not attributable to Elkhart RV Parts or the carrier, you are liable for all outbound freight, return freight, restocking fees charged by the vendor, and any storage or redelivery fees. These amounts will be deducted from any refund that might otherwise be owed, and in most cases will exceed the purchase price, leaving no refund payable.
- You must inspect freight shipments before signing the delivery receipt. Damage or shortage must be noted on the bill of lading at the time of delivery. Concealed damage claims (damage discovered after signing) are handled at the carrier's and vendor's discretion and we cannot guarantee recovery.
- Title and risk of loss pass to you upon the carrier's first pickup from our warehouse or the vendor's facility, whichever applies.
6. Damaged or Defective Items
If a Special Order Item arrives visibly damaged or is defective out of the box, contact us at help@elkhartrvparts.com within 48 hours of delivery with photos of the packaging, the damage, and the product label. We will work with the carrier and the manufacturer to arrange a repair, replacement, or manufacturer warranty claim. This is the exclusive remedy for damaged or defective Special Order Items. Claims submitted after 48 hours, without photo evidence, or after the item has been installed, modified, or used may be denied at our discretion or at the vendor's discretion.
7. Fitment and Compatibility
You are responsible for verifying that the item you ordered fits your vehicle, RV, trailer, or equipment. We provide manufacturer-supplied compatibility information in good faith, but we do not guarantee fitment unless we have inspected your specific unit in writing. "I ordered the wrong part" or "it didn't fit" is not grounds for return, refund, or chargeback on a Special Order Item.
8. Chargebacks and Payment Disputes
This section is the key reason you are reading this page. Please read it carefully.
By checking the acknowledgment box on the product page and completing checkout, you affirmatively waive any right to initiate a credit card chargeback, ACH reversal, PayPal dispute, Shop Pay dispute, or other payment-network dispute against Elkhart RV Parts on the grounds of:
- "Item not as described" where the item matches the product listing;
- "Order cancelled" where the order was, in fact, placed by the authorized cardholder and is non-cancellable under these Terms;
- "Services not rendered" or "merchandise not received" where the item has shipped, is in transit, or has been delivered per carrier records;
- "Unauthorized transaction" where the order was placed from your IP address, your account, your device, or with your payment credentials;
- "Not satisfied with purchase" or any variation of change-of-mind;
- "Duplicate charge" where the charges correspond to distinct orders or line items.
If you initiate a chargeback in violation of these Terms, Elkhart RV Parts will contest the dispute with the following evidence, which constitutes the complete and contractually binding record of your consent:
- A copy of this Special Order Terms page as published at the time of your order;
- The timestamped order record showing the `Special Order Item: Yes` line-item property, confirming you checked the acknowledgment checkbox prior to being allowed to add the item to the cart;
- The full product listing including the disclaimer language, checkbox wording, and reference to these Terms;
- Your billing and shipping information, IP address at time of order, browser session data, and email confirmation;
- Carrier tracking, delivery confirmation, and where applicable signed bill of lading;
- Any correspondence between you and Elkhart RV Parts related to the order;
- Photographs, serial numbers, and manufacturer documentation as applicable.
You further agree that:
- The checkbox acknowledgment is a signed, authenticated consent to a final sale and functions as your electronic signature under the Electronic Signatures in Global and National Commerce Act (E-SIGN) and the Uniform Electronic Transactions Act (UETA);
- A chargeback filed in bad faith — meaning a chargeback filed after you checked the acknowledgment box, received the item or the item shipped as ordered, and have no valid claim under Sections 6 or 7 — constitutes a breach of this agreement and, in certain circumstances, may constitute friendly fraud as defined by card-network rules;
- In the event you lose a contested chargeback, you remain liable for the full purchase price, any chargeback processing fees assessed to Elkhart RV Parts (typically $15–$25 per dispute), any collections or legal fees reasonably incurred, and any difference between the merchandise and its recovered resale value;
- Elkhart RV Parts reserves the right to refer unresolved chargeback claims to a collections agency, to report non-payment to credit bureaus where permitted by law, and to place the customer on an internal "do not sell" list;
- If you dispute a charge in good faith, you agree to contact Elkhart RV Parts first at help@elkhartrvparts.com to attempt informal resolution before initiating a payment-network dispute. Failure to contact us first is additional evidence of bad faith for purposes of this clause.
9. Authorized Cardholder Representation
By placing an order and checking the acknowledgment box, you represent that you are the authorized holder of the payment method used, that the billing information you provided is accurate and matches the card or account, and that you have full authority to incur the charge. Fraudulent orders placed with stolen payment credentials are separately handled under Section 10.
10. Genuinely Unauthorized Transactions
Nothing in these Terms prevents a genuine victim of payment-card fraud from exercising their rights under federal law and their card issuer's zero-liability policy. If your card was stolen and used on ElkhartRVParts.com without your knowledge, contact us at help@elkhartrvparts.com and contact your card issuer immediately. "Unauthorized" in this narrow legal sense means a third party used your payment credentials without your permission — it does not mean that you placed the order yourself and later changed your mind.
11. Warranties
Manufacturer warranties, where applicable, are the sole warranty on Special Order Items. Elkhart RV Parts disclaims all other warranties, express or implied, including any implied warranty of merchantability or fitness for a particular purpose, to the maximum extent permitted by law. Warranty claims are handled directly by the manufacturer per their terms.
12. Limitation of Liability
To the maximum extent permitted by law, Elkhart RV Parts' total liability arising out of or related to any Special Order Item is limited to the amount you paid for that specific item. We are not liable for consequential, incidental, punitive, or special damages, including lost time, missed trips, towing expenses, installation labor, diagnostic fees, or loss of use of a vehicle or RV.
13. Governing Law, Venue, and Jury Waiver
These Terms are governed by the laws of the State of Indiana, without regard to its conflict-of-laws principles. Any dispute arising out of or related to a Special Order Item or these Terms shall be brought exclusively in the state or federal courts located in Elkhart County or St. Joseph County, Indiana, and you consent to personal jurisdiction and venue there. To the maximum extent permitted by law, you waive any right to a jury trial.
14. Severability and Entire Agreement
If any provision of these Terms is held unenforceable, the remaining provisions remain in full force. These Terms, together with the product listing, the checkbox acknowledgment, our general Terms of Service, and our Privacy Policy, constitute the entire agreement between you and Elkhart RV Parts with respect to Special Order Items and supersede any prior or contemporaneous oral or written understanding.
